Manufacture of a Controlled Substance

Manufacturing, selling or distributing a controlled substance can be prosecuted under either state or federal law. In the state of Texas, controlled substances are prohibited by the Texas Health and Safety Code and the Texas Controlled Substances Act. The following commonly used substances are controlled in the state of Texas:

  • Marijuana
  • Methamphetamines

Drug Crime Penalties

The following penalties have been prescribed by the state of Texas for a controlled substance manufacturing conviction.

Penalty group 1 includes the manufacture of methamphetamine, opiates, heroin, cocaine and their derivatives:

  • Less than one gram: State jail felony
  • One to four grams: Second-degree felony
  • Four to 200 grams: First-degree felony
  • 200 to 400 grams: 10 years to life in prison and a fine of up to $100,000
  • 400 grams or more: 15 years to life in state prison and a fine of up to $250,000

Penalty Group 1-A prescribes the penalties for manufacturing LSD:

  • Less than 20 units: State jail felony
  • 20 to 80 units: Second-degree felony
  • 80 to 4,000 units: First-degree felony
  • More than 4,000 units: 15 years to life in prison and a fine of up to $250,000

Penalty Group 2 includes hallucinogens, mescaline, and other substances that depress the central nervous system:

  • Less than one gram: State jail felony
  • One to four grams: Second-degree felony
  • Four to 400 grams: First-degree felony
  • 400 grams or more: 10 years to life in prison and a fine of up to $100,000

Penalty Group 3 includes peyote, pentobarbital, phenmetrazine, codeine, steroids and other recreational stimulants:

  • Less than 28 grams: State jail felony
  • 28 to 200 grams: Second-degree felony
  • 200 to 400 grams: First-degree felony
  • More than 400 grams: 10 years to life in prison and a fine of up to $100,000

Penalty Group 4 includes narcotics that contain one or more nonnarcotic active ingredients:

  • Less than 28 grams: State jail felony
  • 28 to 200 grams: Second-degree felony
  • 200 to 400 grams: First-degree felony
  • More than 400 grams: 10 years to life in prison and a fine of up to $100,000
